Conditions for Participation
in the Creative Competition
of DB Schenker
and SPIESSER 2018/19

1. Object / organiser

These terms and conditions govern participation in the student competition LOG(ist)ISCH.

The LOG(ist)ISCH competition is a Europe-wide school competition that strengthens the development of creative and communicative skills and promotes the discussion of the topic of sustainability and environmental awareness.

The participating pupils (hereinafter referred to as "pupils/students") are invited to develop a contribution for future visions of sustainable logistics individually or in groups of a size up to a maximum of an entire school class and to submit it to the competition. Contributions include texts, pictures, photos, videos, audio recordings and presentations.

The organisers of the LOG(ist)ISCH competition are Schenker Deutschland AG, Uhlfelder Straße 1-3, 60314 Frankfurt, Germany and Orange YC GmbH, Schandauer Straße 64, 01277 Dresden (hereinafter referred to as the "organiser").

By applying for the student competition, the pupils accept these conditions of participation. In addition, the information provided on the website apply.

Participation in the LOG(ist)ISCH competition is free of charge.

2. Terms of participation

Individual pupils and groups can participate. The group’s size may not exceed an entire school class.

Within these groups, only pupils in grades 9 to 13 from countries of the European Union are eligible to participate.

Family members of the organisers are excluded from participation.

Each group appoints a group leader (hereinafter referred to simply as "the leader"). If the group has a supervising teacher, he or she can also assume the role of the person in charge. The person responsible is the contact person of a group to communicate with the organiser. This especially applies to the transmission of information on the competition and the sending of entries. The leader undertakes to forward all information immediately to all team members.

He or she also undertakes to obtain all necessary declarations from the other team members and to forward them to the organisers.

The responsible person will obtain the express consent of the group members to make declarations to the organisers on behalf of the group and to provide the organisers with personal data of the group members, in particular name, address, date of birth and e-mail address for participation in the competition as well as the application for participation in the competition.

In the case of an individual participation of a student, the participant himself is also the person in charge.

Students who have not yet reached the age of 16 at the start of the competition (submission of first entries) require the consent of a legal representative to apply and register, which must also include the inclusion and validity of the conditions of participation and data protection provisions. This is guaranteed as soon as the legal representative or a teacher is appointed as the person responsible for the group.

3. Submission phase

The school competition LOG(ist)ISCH is divided into a submission phase, an evaluation phase and an award ceremony. The organisers reserve the right to postpone the dates specified in the Conditions of Participation within a reasonable period of time if necessary.

a) Einreichungsphase

Students can apply for participation individually or in groups by filling in the participation form on the website . The application comprises two parts:

  1. The participation form:
    To register for the competition, the person responsible for the respective group must submit their name, address, date of birth, e-mail address and team name (only if they are participating as a group). When registering as a school class, the school that the team attends must be indicated with the full address and class name. The person in charge also indicates the number of pupils in the group. Participation creates a profile of the group.

  2. The contribution:
    The competition entry can be uploaded directly by the leader when registering or later via the group profile on the competition homepage. It is also possible to send the submission by post to the organiser Orange YC GmbH.

The submission deadline is 31.12.2018, 23:59.

All participants and groups who have registered in time will be contacted by 10.01.2019 at the latest via the responsible person and the e-mail address provided with the registration and informed that their registration was successful.

After the deadline, a group can no longer be expanded. However, group members may withdraw from the groups and the remaining members may continue to participate in the competition with the project of the whole group.

b) The evaluation phase

All entries submitted to the competition will be reviewed by a jury consisting of employees of the organisers in a jury meeting lasting several days, if necessary, and objectively assessed on the basis of an evaluation guide. The winners of the competition will emerge from this jury meeting: Category individual participation and category group participation.

The exact procedure of the jury meeting is set out in the evaluation guide, which will also be made available to all participants of the competition via the competition homepage.

c) The awards ceremony

The winners will be announced via the e-mail address provided at the time of registration and on the homepage of the competition in February 2019.

4. Projects and participation in the competition

The participants will not be paid any fee or expense allowance. The participants or their legal guardians shall bear all costs of the preparation of the competition entry.

Projects that are not permitted at the competition are those that

  • endanger the participants or third parties,
  • glorify violence,
  • use or research military technology or weapons,
  • were not personally created by the participantsn,
  • violate applicable laws.

Entries and projects must not have already been submitted to other or previous competitions.

If external contributions are quoted or used, they must be marked as external and provided with a reference; in addition, this use of external content must be legally permissible (legal permissibility or proven rights of use).

During the duration of the competition, projects, products or services resulting from the competition may not be marketed in the context of setting up a business or be prepared for marketing.

The participants undertake to treat each other and all participants in the competition with respect.

The organisers reserve the right to exclude participants from the school competition in the event of a violation of these conditions of participation. Projects that do not comply with the conditions of participation may be rejected or excluded from the competition at any time. Also excluded are participants who make use of unauthorised aids or otherwise gain advantages through manipulation. The organisers may also subsequently pronounce such exclusion, withdraw prices or reclaim them. The organisers are free in their evaluation.

With the application for the competition and the registration for the competition, the participants or, in the case of minors, their legal representatives, ensure

  • that they recognise the conditions for participation
  • that they independently created or will create the team’s entry,
  • that they have marked all contributions of third parties and used quotes with sources and references,
  • that the personal data of the participants as well as photo and film taken in connection with the participation in the competition may be used for reporting on the competition and the press and public relations work of the organiser and may be passed on to third parties.

The languages of the competition are German and English.

There is no legal entitlement to participate in the competition or a price.

5. Jury and decision of the jury

The jury is appointed by the organisers.

The decisions of the jury will be made outside of the public’s presence. They are final and not subject to appeal. Legal recourse is excluded.

6. Prices and collecting the prices

The winners will be announced in February 2019. The winners agree that their names will be made public.

The winners will receive the following prices:

Single winner:

1. place: A long-board - Arbor Pilsner Bamboo 28.75

2. place: A Fjällräven Kånken backpack, 16 L

3. place: A EUR 50 voucher for the Avocado Store

Group winner:

A EUR 500 cash price.

7. Rights of use

The participating students ensure that they are the authors of their submitted contributions and that the submitted documents and media, in particular also pictures, film, sound and text contributions, do not violate any rights of third parties. The participants further ensure that they have obtained the necessary rights of use, including the right that the content may also be used by the organisers within the framework of the competition and to the extent of these terms of participation, for all content of third parties whose use requires the granting of rights. Participants must submit the necessary supporting documents together with their contributions, documents and media. The organisers are not obliged to check the content provided by the students (e.g. texts and pictures) for potential violations of the rights of third parties. However, the organisers are entitled to refuse content if, in their reasonable opinion, it is unlawful or contrary to accepted principles of morality.

The rights to the projects, the developed concepts and competition contributions remain with the pupils, subject to the use of the following option right.

The students agree that their competition entries in connection with the LOG(ist)ISCH competition may be used by the organisers for public relations purposes in online and offline media (e.g. print media), disseminated and otherwise made publicly accessible to third parties.

The participating pupils therefore grant the organisers the non-exclusive right, to use the competition entries themselves or through third parties, and in particular to reproduce, disseminate, make publicly accessible, edit, translate and - to the extent necessary for public relations work - grant third parties rights of use to the competition entries for the purposes of public relations work, free of charge in terms of time, space and content.

In particular, the organisers have the right to report on the LOG(ist)ISCH competition and on the groups taking part in the competition in words and pictures, with names and images (film, photo) and to use this in the media. In addition, the students of the winning groups or the individual winner undertake to make themselves available to the organiser free of charge to a reasonable extent for audio, photo, image and text promotion on the radio, the Internet or printed publications.

8. Disclaimer of warranty and liability

The organisers reserve the right to cancel the school competition LOG(ist)ISCH at any time for important reasons and to cancel or end it at any time. This especially applies in the event of force majeure or if the school competition cannot be carried out or continued for other organisational, technical or legal reasons. The organisers will make use of this option in particular if, for technical reasons (e.g. viruses, manipulation) or for legal reasons, it cannot be guaranteed that the school competition will be carried out properly.

In such a case, the pupils are not entitled to any claims against the organisers.

There is no legal entitlement to participate in the competition. The organisers are not liable for the uninterrupted accessibility of the internet portal and/or the successful upload of the competition entries by the leaders.

The organiser shall only be liable for damages if the damage is attributable to intent or gross negligence on the part of the organiser. The organisers are also liable for culpable injury to life, limb or health of a natural person in the event of simple negligence.

In addition, the organisers are also liable for only slightly negligent violations of cardinal obligations. Cardinal obligations are those whose fulfilment is essential for the proper conduct of the school competition and the achievement of the purpose of the contract and the competition, and on whose observance the participants may regularly rely.

This limitation of liability applies in particular to damage caused by errors, delays or interruptions in the transmission of data, faults in the technical equipment or services, incorrect content, loss or deletion of data, viruses or in any other way when using the application. The liability according to the product liability law remains unaffected.

9. Applicable law

The conditions of participation are subject to the laws of the Federal Republic of Germany.

10. Other legal notes

Deviations from these terms of participation must be in writing in order to be valid. The same applies to the waiver of the written form requirement.

Legal recourse is excluded.
